SOME THINGS THAT YOU NEED TO KNOW ABOUT MOORINGS IN FRANCE:
- The harbours are all situated in waters owned by the
state. And therefor no private person can be "owner" of a part of water in
which you can moore a yacht.
- The ports where build either by the town where they are
situated, or by exploitation companies who where appointed to exploite the
ports.
- From the day the ports where build, a "consession" of a
limited time where given to the explotation companies.
- This time varies from town to town, but 50 years is most
common.
- If you buy a mooring, you actually buy shares in the
explotation company, and gives you the right to use a part of water = share
until the consession ends.
- After this period, you loose this right, and in principal
the port goes back to the state.
- However, there are court cases running that try to change
this law.
- If you rent, you always rent from a private person that
owns the mooring/shares.
- A few years ago, the owners of the moorings could rent out
their moorings to private persons and set their own rate. In other words, one
could make even a profit on owning a mooring.
- However, in the initial consession contract made between
the owners and explotation company is written that only the harbour master is
allowed to rent out moorings at the standard rate, which is much lower then
the rates calculated on the purchase price. This rule is now actually applied
in all ports, as it was a reason for the state to take back the consession
earlier as foreseen initially.
- As a result fewer and fewer owners want to rent out their
moorings on a yearly basis.
- Nevertheless, there is a great shortage on moorings, and
they are still sold at very high prices.Even with just a few years of
consession left. Most people believe that the state will loose their right to
take back the consession, and take the risk.
WHAT YOU SHOULD BEWARE OF:
- Always check before buying how many years are left on
the consession
- Check carefully the measurements of your yacht
including it's fenders, some people say that 5cm doesn't make any difference.
This is not true. You will be refused.
- When you rent from a private person via the harbour
master, you have no rights, and you can be asked to free the mooring anytime.
Even when you've paid the full amount for a year in advance.
- Carefully check the contracts, they must be according
to the port rules.
